The support section states it should only be used with stock intakes but NJlakeshoreG used it with his Stillen intakes and he didn't seem to run into any issues.

Yes you can run aftermarket intakes. According to John at Cobb, the HFC'S will be more likely the cause of your car to lean out than any aftermarket intakes. I will post some AFR readouts with my JWT'S and INJEN CIA'S once i get mine in

As per John at Cobb, the 09 ROM is not available yet but they will be available soon.
