Trial by Declaration and put this

The officer has alleged that my window tint was too dark. The most important part of this code for most drivers and applies to the front side windows: “Notwithstanding subdivision (a), clear, colorless, and transparent material may be installed, affixed, or applied to the front side windows, located to the immediate left and right of the front seat if the following conditions are met: (1) The material has a minimum visible light transmittance of 88 percent.”
If at least 88% of light transmits through the window, the tint is legal. My tint was factory installed by Infiniti and the car was legally sold in California as meeting all applicable vehicle codes. There is no evidence that my tint is too dark. The officer simply guessed without any objective scientific measure of my tint density. Since the human eye cannot discern between 88% (legal) and 87% (illegal) light transmission through tinted glass, I submit that his guess is not credible evidence.

I'm guessing the officer didn't use a tint meter .
I know the have to here if their got ticket you for it. Even the state inspection stations use them when they inspect the car .

Motorcycle cop, no meter. I got the "correctable" infraction. He used the eyeball test. I'm required to remove before inspection. Such a hassle.

In Florida it's a secondary infraction. I've not heard of anybody I know being pulled for just tint. I do know a few people who got pulled and were issued this infraction as icing on the cake for speeding or some such offense. LOL Damn cops.

I really can't complain as I was speeding on a 25MPH curve. He gave me a warning on the speeding but hit me with tint to warrant his time. I will take tint over a moving violation any day. Isn't it obvious that our Gs can handle a 25MHP curve going 45+?
I will pay the fine when I get a day off.

Only 45+? I got to watch it as well. My tint is illegal and I like hitting the curves a bit strong. Tint infraction over a speeding ticket any day.

G'luck dark tint is probable cause....bastard picked me out over speeders

Youll be amazed to see how deep the side spot light penetrates . And telling drivers to put their windows down before getting out of the car is another option. But you are right limo tints at night are considered extremely dangerous to a police officer at the time of a traffic stop. Remember I want to go home at the end of my shift.
