NY state speeding ticket- questions

So I am a CT resident and was driving up to Montreal for a bachelor party yesterday. Just for my car a week ago and was getting a little too over zealous on the open road. I tagged going 88 in a 65. According to NY state guidelines that's 6 pts and with the way the state troopers do it you don't find out the monetary amount of the fine until you plead guilty and send it to the local court.

The trooper was really nice, he saw that I had only had the car for about a week and he mentioned how he just bought an fx35 so he felt my pain with going fast and not really feeling the speed. Anyway he said that you can request a reduction via mail by contacting the DA or the court or something to that effect but I can't find any information on this... I also don't know if I plead guilty first and then do this reduction business? Also, should I call my insurance company and talk to them about the ticket? This is the first moving violation I have ever had since I got my license at 16(I'm currently 27). If anyone has any incite regarding these issues and could share that would be really great. I'm worried about my insurance shooting through the roof and want to get the ticket reduced as the trooper described but don't know how.

I have never heard of what the trooper stated but I hope that it works out for you. I was just on the parkway and I was about get out of the fast because I felt I was going slow. When I looked at the speedo I was doing 65. It's hard to feel the speed with the windows up.

Where were you when you got the ticket? If you were deep upstate, then a lot of these little towns just care about one thing, $$$. I would call the court in the town/city you got the ticket in (the courthouse you would go to in order to fight the ticket). Be nothing but polite and explain your situation. Ask if there was anyway you could speak with the judge, at his convenience, who overseas traffic court. With a little luck you will be able to plead your case to him and hopefully reduce the ticket. Expect a hefty fine.

This happened to me years ago outside Herkimer NY. 85 in a 55. I ended up getting the ticket reduced to just a $380 fine. Better than points though. Good luck.

sounds to me like your main concern is your insurance shooting up.

first, lets answer your questions.

1. your ticket that you got in new york will go on your driving record here in CT.
2. if what the officer said about the "points" being 6 in NY, then you will have to pay an "assessment" court fee. from the research i did, anything under 6 doesn't get the fee. this fee will most likely be paid on top of your fine.
3. when your driving record gets a blemish your insurance rates go up. now, if you've never received an infraction before, it may not go up as much as you think.....maybe a couple dollars a month.
4. even though this infraction is going on your CT license, from what i have read, it will not deduct "points" from your CT license. it only appears in CT in case of future infractions.
5. i would NOT contact your insurance company to tell them you got this infraction. HOWEVER, you may want to ask some "what if" questions to your agent like "what if i were to get a speeding ticket in NY...what happens?" or "if i were to get a speeding ticket how much would my insurance go up?"

i'm not a lawyer and this is only from what i've read on the interwebs.

other people have had this similar issue from what i have read. some have pleaded "no contest" meaning you're not admitting guilt, but you're paying the fine just to be done with it. i would look into this. have you tried contacting the county courthouse where you were stopped? there is supposed to be BASIC information on the infraction ticket like county, town, officer name/number, and there should be some contact info/address on the reverse side of the infraction.

but the absolute BEST thing you can do is direct your questions to an attorney.

Thanks for the kind words. I figure I'm going to have to pay out of the a** just hoping I can get the points reduced. I have the courthouse info so I will have to make some phone calls and make some inquiries. There is not a "no contest" option on the ticket... Just guilt or not guilty and I don't want to plead not guilty because I do not want to have to make a court appearance as it would be a 5 hr drive from where I live and I doubt I would do me any good. I guess the alternative is just plead guilty and get the ticket amount and pay. Now, if i plea guilty having been going 23 mph over am
I in danger of getting a reckless driving charge or other charges and have to go up to court anyway? Did anyone with a similar experience retain a lawyer?

Last time I got a ticket out of state (NC), I ended up getting a lawyer to deal with it. By the time all was said and done, it cost ~$480 including the fine, lawyer fees and traffic school that I took locally.

You'll probably be getting letters from lawyers in the mail in the coming weeks soliciting their services. Talk to them, they'll give you some idea of what to expect, fees, etc..

Mine got reduced to an equipment violation (thus the cost was higher)... Which, as you can see, it's all about the $$.. I went with this option rather than saving $50 or so because no points, no blemish, no big deal. Also, it was bound to happen sooner or later. I've gotten away with insane speeds on the bike for years past. Ironically, just today, I was <pleading the 5th>... LOl.

I got a ticket in the middle of the forest in the adirondacks, ~65 in a 45. ~2007/8, $200+$50 court fee=$250 (or it might have been $250+50, can't remember). I imagine yours will be similarly priced. I didn't strike any agreements, but I also don't think my insurance company cared (rates didn't change).

The town wants the $$. NY won't let you off without paying, but you can probably get it changed to a non-moving violation if you call the town court.

I recommend cruise control, 70-72mph, and staying in the right lane. No fun, but no tickets. Good luck!

so you just pled guilty and waited for the ticket assessment to come in? I will call the court tomorrow and try to talk to someone. Did you get points on your license? I pretty much did the cruise control thing on the way back.

I was in the same situation I got a ticket ij NY living in CT I ended up paying $300 for the ticket and they hit me with an additional fine of $300 for getting points. But I can pay the $300 annually so they broke it down to $100/year. Im not sure how the points work, I heard they don't transfer.

the points do transfer from what the trooper told me. From what I've read often the town court will reduce the points and change the nature of the ticket so that the township gets the $ and they don't have to share with the state but this requires going to court. I've found an attorneys office that does traffic violations. They will go to court on your behalf. I'm hoping that the reduction in points they may be able to get me will save me money in the long term. I am waiting for a phone call back from them.

Yep, I just plead guilty and waited. As far as I know, I did not get pts on my license (I did some digging on this and only conclusion I could come to was that NY and VT weren't talking to each other).

I would not bother with a Lawyer. Since you were speeding, he will cost you more $$$ than he will save you.

The Trooper mentioned contacting the DA. I would do this. In most states, the DA will look at your driving record, see it is clean, and offer you a reduced offense and fine.

The reduced offense will reduce the hit you are going to get on your insurance rates. The slightly lesser fine will be nice too.

I was picked up in NY 4 years ago and just paid the ticket. No points were taken off my Kentucky license. I was picked up out of a line of about 7 cars all doing the same speed.

Never showed up on my NY record. Turns out NY doesn't recognize when you get points in other states and my insurance never went up.

I just paid my fines by mail and that was that.

Not sure if its the same the other way around.
