First Time got Rear Ended Need Advice

First Time got Rear Ended Need Advice
Two weeks ago someone hit my parked car in a shopping mall parking garage and ran. I was working and my Viper alarm vibrated so I ran outside and no one was at the scene. Someone tried to park and turned too wide and too fast and side swiped my driver's side rear bumper and quarter panel. Filed insurance and claimed it was a hit and run and was able to get it taken care of.
Fast forward to yesterday morning I pick up my newly repaired car from the shop. I was able to get an IPL rear bumper out of it to match with my IPL front and side skirts. I was super stoked when I picked her up. Left for work after meeting up with some of my friends at a coffee shop and I get rear ended by a Mustang at an exit ramp. Lexus IS two cars in front of me doesn't know how to merge so he stopped abruptly(rolling 35-40 to almost a dead stop). I was lucky to not hit the convertible BMW 335i in front of me thanks to our sport brakes .
Unfortunately for me the Mustang behind me did not stop in time and rammed me in the ***. The impact felt quite strong I thought my rear end was done for. I was surprise to see that my rear bumper had a crack and some deep scratches and a screw imprint from their license plate. Gave it a closer look and it seems the impact point was my rear license plate since it was bent inwards. Their car seemed unharmed because they basically hit me where their front license plate was.
Exchanged information but did not get a police report because I felt fine and the damage seemed minimal. The girl who hit me tries to not involve insurance. Fast forward a couple hours later I feel soreness in my back, neck, and shoulders. I text her to see how much she is willing to pay and it seems that she is not willing to go above $500. She admits to hitting me through text message and we go back and forth about if I should report it or not. Anyways I ended up calling my insurance because I am worried that I might need medical care.
I need advice on what to do next. I am not trying to screw this girl or out to make $$$. Just trying to cover my *** and protect myself.

You might still be able to file the police report since you have her info. Not sure though. She might try to deny it at this point. Don't wait too long. For future reference, you should always call the police from the scene of the accident. The police will collect all information from the drivers involved and file the report. Then call your insurance company. This is the safest way to ensure you don't get screwed. When you get rear-ended, it is nearly always the other driver's fault for not stopping in time, so you will not run the risk of your insurance going up.

Thank you for all your help. I will definitely file a police report first thing in the morning. I believe that CA is not one of those no fault states so my insurance premium shouldn't go up as long as it is the other party's fault. I am just sad I didn't even get to enjoy my aero rear bumper, I was lucky enough to get one without sensor holes.

File a police report immediately, and do go through your insurance. You'll have to pay the deductible, but after it is determined you aren't at fault and your insurance collects from the other insurance, you'll get the money back. And your premiums won't go up.

File through insurance, see a medical doctor. They'll most likely prescribe you vicodin or lortab for your pain, followed by recommending seeing a chiropractor. Enjoy the free massage!! Hope all things go well for you bro

Thank you for all your help. I will definitely file a police report first thing in the morning. Only thing you need to know. If someone hits you you always call the police and get an accident report. End of story.
I got hit in Manhattan last week, the damage that looked to be nothing, wound up costing $1600 to fix. The NYPD officers that showed up even said I shouldnt even bother filing a police/accident report. Ha. I'm not an idiot, *******s.

Yeah, lesson learned next time I will definitely call the police to the scene. I didn't call the police because the girl who hit me was quite apologetic and nice. I am having my insurance company deal with hers and will update on how this plays out. Filed a police report this morning and I feel a lot better now. Thank you so much for everyone's input!

Yeah I have no idea how the dealership I ordered from was able to get it without holes. The parts manager called the warehouse but they refused to cooperate with him to make sure they ship one without holes because they don't want you "modding" your car. I was ecstatic when the dealership called me when they received it and told me that there was no holes. The bumper came with instructions and a template for drilling the sensor holes. Anyways, I am just hoping that the shop can fix it to looking new again.
