Carfax usually won't show minor accidents unless it was reported. I believe it's only when reported to DMV that it shows up.

Is the dealer going to fix it?

whoaa. Mine has had this from day one and I bought it brand new.

I've always thought they were made that way because it's even on both sides.

Anybody else in the same situation?

That's the first time I see that unless someone bumped you and you didn't notice it right away.

I bought mine car brand new and the same thing happened to one side - there is a bracket on the inside on the bumper that is supposed to snap into place. When I took my car back they had to remove the whole bumper and replace a piece in the bumper I believe. So it is quite possible that a part in there is broken or not aligning properly.
