extended warranty or pursue Lemon

2008 S coupe (in-service date 10/24/08)

1) engine noise during cold-warm starts and was told "noise is normal," TSB with ECM reflash and Ester oil (VVEL), engine got replaced at 6k miles after BBB arbitration which an Infiniti Technical Specialist attended and commented that if it was a "serious noise." Not the regular VVEL problem I take it. the problem was diagnosed or tried to fix by Infiniti at least 3 times (Lemon limit).

2) noise came back, Infiniti consumer affairs (a couple of fast talking guys in suit) came out... back and forth verbal exchange - "noise is normal" once again.

3) current offer/solution: 96 months or 100k miles extended component warranty pending my agreement.

and, I have just been with out my car for 7 days. Tuesday starter was shot (12k miles), waited 2 days for 24 hour roadside service to pick up the car. Reasons ranging from: code Blue (weather related), wait for the weather to get better, waiting for storm to pass, waiting for street to be plowed... then the car was 'impounded' at some tow-company lot for 2 more days, delivered on a Saturday to the dealer (closed on Sunday). Wait for parts on Monday, done by Tuesday

I like the car, just not this much trouble

any thoughtful opinions?

Hmmm with knowing very little about your situation...
Is the extended warranty offered with a precondition that you will not pursue application of the Lemon Law? If so I would consult an attorney before making that decision.
If after doing so you feel you have a strong and valid case for a Lemon, it would then seem as if that would be the most advantageous solution to you. If there are no preconditions, why not take the extended warranty and if he problem occurs again you can still excercise your rights protected under the Lemon Law.

very good advice Kahboom, I was thinking the same thing. They just said that is what they would offer, and the consumer affairs rep. calls me the other day but I did not clarify with her whether or not it is a conditional offer. I said I would have to wait b/c the car is in the shop again.

I would ask them t put their offer in writing so that you can look at it... hope it works out for you.

I wouldn't take the offer if it means you lose you right to use the lemon law - if something unrelated to the engine happens next month or next year, you'll be left with few options.
Unless it's a bumper to bumper warranty. Also, you could negotiate for free maintenance during the 96 month warranty period.

If you're not giving up your lemon law rights on that car, then fine.

If you are, I'd tell them they are crazy. It's not like most new cars, Infiniti included don't already have nice warrentys to start with, one of a few reasons why I never buy an extended from a car dealership when the finance manager tries to push one.

So...be pretty leery and read everything. Don't sign away your rights for what is basically something that isn't very expensive at all on their end to give away.

It depends on whether you plan to keep the car a long time or not. If you have absolutely no intention of keeping it beyond that time or mileage, I'd consider the extended warranty (only if it's bumper to bumper, not power train only) if they also agreed to do all scheduled maintenance. If you're keeping it long term, I'd lemon it and get another car.

I think one other consideration would be if you can financially afford the lemon law. From what I understand, they prorate the value of the car and give you back a 'lesser value' based on miles, time and useage. I think you might want to consider this with how much you owe on the car and if it financially makes sense to in fact lemon law the car. I don't know much about the lemon laws, but heard this from someone who lemon law'd a 5-series BMW ... he said after a year he lemon law'd it and the payoff he got was just enough to cover the balance of his loan. The offer of an extended warranty seems ok if they keep the lemon law clause, but there are a lot of factors such as time and aggrevation that would also have to be factored. This is a pretty big decision at this point, so I would perhaps consult an attorney as well as they will have more insight. Good luck!!!

Keeping in mind I don't know cr@p about this situation. I'd say go lemon and buy a new one with the $$. Troubles like this aren't normal. The warranty is nice, but, a new car comes with a warranty too?

Just get rid of it ! Infiniti USA sucks. I don't have engine noises but other unusual things and the people at Infiniti are still trying to convince me that 2 qt. of oil usege is fine every 5k miles on a car with barely 20k miles. That's my first and last Nissan I am buying!
I thought BMW had issues but honestly, at least they take care of their $hit.

I am mixing up a legally lethal concoction that perhaps will involve some Lemon!

Very good thoughts guys, thanks. My intention is to keep (the 0 down and .9% financing!) the car and have it covered under extended warranty with no obligation on my part, if not, Infiniti can exchange my car under the Lemon law - I'll be happy to keep paying them $600/mon.

Talked with Infiniti consumer affair rep., I asked the questions. The extended warranty does not have any pre-condition, no waiving of Lemon law rights, but it's only for power train. No need to sign anything, just agree over the phone. I haven't suggest free schedule maintenance yet.
