Rear-Ended

I was rear-ended in stop-and-go traffic on the interstate a couple of weeks ago. The young girl that hit me was obviously not paying attention. She hit me and pushed me into the car in front of me too. Fortunately, only the right front corner of my car was affected from that impact.

Here's the deal: New rear bumper, 1 new rear tail-light, minor straightening of rear floorboard, new HKS exhaust, new front bumper (even though it was barely damaged), 1 new headlight assembly, new right front quarter panel, alignment, and painting/blending. All coming out to $9,400.

My insurance company is advising that I go after "Devaluation of Vehicle." They seem to think since the car is only 9 months old with 11k miles and (was) in perfect condition, I should get between $4,000 and $8,000 on top of the repairs.

If the car drives the same, I may just keep the money in the bank for when I trade in the car in a few years. If not, I guess I'll just trade it in for another one.

wow, they actually have a "devaluation of vehicle" I always wondered what happens if your high end car gets into an accident and its not your fault, I really think its not fair that your car is way less in value when you trade it in just because of an accident that wasnt your fault at all, and to make it worst, some insurance company actually pay you for aftermarket parts on your bmw or mercedes, or lexus, or infiniti when you should be getting oem parts, its like rear ending your infiniti and paying you back with a nissan altima coupe instead of a G37, you get what i mean? I actually talked to an insurance adjuster about this before and he claims that its illegal for the dealership to penalize your car for being in a previous accident. I dunno, its a no win situation regardless

I've already received the check for all the repairs, as well as a check for $1500 for missing a day of work.

They are filing the paperwork for what Virginia is actually calling "Diminished Value." I've been told by the appraiser that it is 14%-18% of the pre-crash value.

I'll let you guys know what comes out of all this.

Damn, a lot of G's are getting rear ended lately.. sucks.. I'm worried now lol.. Anyways hope everything works out. BTW that undercover charger is ill.

I'm a newbie too.
So will the other party's insurance cover mods like if the wheels or exhausts were damaged?

$1500 for missing a days work?!

What do you do for a living? Neurosurgeon?

Yep, they have to cover what was damaged regardless of stock/aftermarket. Most Insurance companies will ask for receipts though, so hold on to them!

I'm a Creative Director at an agency.

Good news. I just met with my "Diminished Value Appraiser." He says that as long as the accident was not my fault, my car has never been in an accident and the repairs are more than $1k, then I'm entitled to diminished value by law! You just have to pay an appraiser (not dealer/body shop) to do the official appraisal and fill out the appropriate forms. His fee is $250, but that goes into the settlement.
