Oh man! Sorry that you are dealing with that with your new G. I hope they get it repaired well. That really sucks I feel bad that it happened to you.
Be sure to make a DIV (depreciation in value claim) I got a feeling that the repairs are going to be costly on that one.

i second that. sux dude. i remember how pissed i was when i scrapped my front right wheel (1 inch gash). i hope you get it back just like new! it could be worse.
i knew someone with a brand new S4 who left the sunroof open in the pouring rain over night. he got the car on a thursday and it rained that saturday night. it never had that new car smell again =(

Brakes failed?!?!?! Give me a break. I think it's time for him to do the responsible thing and stop driving ... what if it was a neighbor's kid he slammed into?!

and yeh his LS460 shouldve parked 4 him but hes an old guy like 75yrs old and i think he hit the gas instead of the brake bec. he told me that his brakes failed ... HOW THE HELL TO BRAKES FAIL ON A BRAND NEW LS460

I spoke to the dealer today about getting a new one and it will prob cost about $10,00-12,000 to do that
maybe because the guy was loaded off his *** and could buy 20 of these cars cash ... he will pay 4 it
when he hit me i told him im gonna want a new one and he said he understands and seemed ok with it but now that i know it will cost abt $12k we have to see ill prob call him tom. or wends ill keep you guys posted

Oh man.
That's just about as bad a day right there as you're gonna have. He must have been really moving that boat to do that much damage. I am always freaked out when I park on the street that I will find my car like that.

That is a claim made to the responsible party's insurance company for depreciation in value of your car resulting form the accident after repairs are done.
In our state if the damage was more than a certain amount, it depreciates the value of your car vs what it would have been prior to the accident. Be sure to look into that instead of just settling for the repair costs.
Get your car appraised at a few places and disclose the damage. Get a written appraisal and compare to/ subtract it from what the car should be worth undamaged. Submit a claim for at least that amount.
However if the other party is offering to buy a new car- take that deal and don't make mentioned of a DIV claim.
