No, they had the trans out of the car and the clutch on the ground when they told me about the 70% left

That's a part with a known problem and well within the factory warranty of the car. The problem didn't just happen it's been happening and has been shown to be an issue. DO NOT SETTLE FOR THEM CHARGING YOU...PERIOD.
I called Infiniti and they said that the Slave cylinder is not covered under the powertrain warrany. I have 60,150 on the car

What is it covered under? My statement is that it's a none issue and probably failed before you bought the car.

They took the tranny out without just testing the known issues? Wow.

I'd argue A with the dealer they sold you a POS. And with Infiniti that it is a known issue.

I don't see how a slave cylinder could not be considered a warrantable powertrain item. It isn't a wear item so it should be covered. I'd take this up the chain of customer complaints...

definitely slave cylinder...
same thing happend on my 08 6MT and fortunately was covered by the factory as i only had about 18K miles....

Sucks that you have to pull the tranny for this. I had a Miata with a bad slave and did the job my self for $40
