After so much BS the dealer finally agreed to do the TSB which ended up being a new short block... will repost in about a week when the part is in.

Finally got the new block in. The car makes the same noise. The tech says he cannot hear it. All of my friends hear the noise and my mechanic (not infiniti) hears the noise... My mechanic thinks it has something to do with the engine mount or a sound deadening issue in the car. The noise can only be heard inside the cabin and is definitely coming from the engine... Any insight would be greatly appreciated. I am still under warranty.

Contacted the consumer affairs line to try and resolve this. They said take it back to the dealer and have them listen to it again. The dealer keeps saying its normal nose and I am hearing the injectors... Does anybody know if the TSB for the VVEL applies to the 2009 sedan??

So I brought my car to a different dealer and they identified the noise as a faulty fuel line dampener. Replaced the part and the noise is gone!
