Wow, it sucks. I don't see an easy way out here. It's cheaper to keep the car if you have enough saving to cover the payment. If you want to get rid of it now, I would guess, 5-7K below invoice.

Well, you can get this car for about $1500 under invoice w/o much negotiation. With some negotiation and shop around, you can get it 2.5-3k under invoice.
if a dealer gives you 7k under invoice and they need to make 2k after all the expenses (salesman, gas, detail, etc.), they have to sell your car about 4K under invoice. Will you buy a used $37-38K car just to save 1-2k?
If you buy a new car from the dealer, they probably don't care if they're going to make 2K on your old car or not b/c they make money on the new car.
When you buy a car, you should expect at least one year depreciation regardless if it's only a couple months old.
