Help Bad rust

Bad rust

Exactly 7 days ago I bought a 2009 infiniti G37 from a dealer. I love the car. Last night I started it up and something on the exhaust broke. I talked to the dealer and they are fixing it no charge. I looked under it today and found what was loose on the exhaust. I also found really bad rust and am wondering what part this is so I can tell them to replace it. Also wondering if it is safe to drive

Front cross member? It's kind of hard to tell.

Poke it with a screwdriver if it pokes through then no

After doing some extensive research and looking at it better, it is the front crossmemeber k frame and I did poke it and hammer it and it wasn't as bad as I originally thought. Still pretty solid but I am still going to demand the dealership replace it. They are already fixing the exhaust that broke and my steering wheel switch that doesn't go back up. I bought it from carmax and they guarantee that they don't sell vehicles with bad frames or frame damage. I'm pretty sure this would qualify.

That doesn't look like the K frame(Subframe), it looks like the cross brace on the AWD sedans...you can drive the car without it fine, you may just notice it doesn't handle as well...maaaybe... anyways it commonly rusts, I think most ppl just pop it off (comes off with 4 bolts and nothing is in the way) clean it up and spray it with some paint...used replacements are cheap too if you're making the dealership do it
